Summit Club Terms of Service and Booking Conditions

OVERVIEW

Welcome to Summit Club! The terms “we”, “us” and “our” refer to Summit Club. Summit Club operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Summit Club is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (“Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services or book onto one of our challenges.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers, limitations of liability, booking terms, participation requirements, and self-guided disclaimers.

By visiting, interacting with or using our Services, or by placing a booking with us, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you should not use or access our Services.


1. ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.


2. OUR PRODUCTS

We aim to provide an accurate representation of our products and services online. However, appearance or colour may vary depending on your screen settings. We do not guarantee products or services will meet your expectations or match exactly what is depicted online.

Descriptions of products and services are subject to change at any time, and we reserve the right to discontinue products or services without notice.


3. ORDERS

By placing an order, you make an offer to purchase. Summit Club reserves the right to accept or decline your order. Orders are not accepted until Summit Club confirms acceptance and payment is processed.

Purchases are subject to return or exchange only in accordance with our Refund Policy. You represent and warrant that your purchases are for personal or household use and not for resale or export.


4. PRICES AND BILLING

Prices and promotions are subject to change without notice. You agree to provide current, accurate billing and payment information. Prices are exclusive of taxes, shipping, handling, or customs charges unless otherwise specified.


5. SHIPPING AND DELIVERY

Shipping times are estimates only and are not guaranteed. We are not liable for shipping delays beyond our control. Title and risk of loss pass to you once products are handed to the carrier.


6. BOOKING AND DEPOSITS (FOR CHALLENGES)

  • A deposit is required at the time of booking to secure your place on a challenge.
  • All deposits are non-refundable, except if Summit Club cancels the challenge (see Section 11).
  • The remaining balance of your booking must be paid on or before the day the challenge starts.

7. CHANGES TO BOOKINGS

  • You may request to move your booking to an alternative available date free of charge if you provide at least 30 days’ notice before the challenge start date.
  • Requests within 30 days of the challenge will be reviewed case by case; changes cannot be guaranteed.

8. SUMMIT CLUB MEMBERSHIP

As part of your challenge booking, you will automatically be registered as a member of Summit Club at no additional cost. Membership provides you with access to relevant updates, resources, and member communications to support your participation. You may opt out of non-essential communications at any time by contacting us.


9. SELF-GUIDED DISCLAIMER

Summit Club operates on a self-guided model. You or your group are solely responsible for navigating the mountain routes and making your own safety decisions while on the peaks. Summit Club only provides logistical support, transport, accommodation, and coordination services.

You will be required to sign a disclaimer form before starting the challenge, acknowledging:

  • You are responsible for your own navigation, safety, and fitness
  • Participation is entirely at your own risk.

10. INJURY AND PERSONAL RISK

Mountain activities carry an inherent risk of injury, illness, or worse. By booking with Summit Club, you acknowledge these risks and accept full responsibility.

Summit Club is not liable for any injury, loss, or damage incurred during your mountain activities since our service does not include guiding or supervision on the mountain itself.


11. ARRIVAL TIMES AND LATE ARRIVALS

Participants are responsible for arriving at the meeting point on time, as confirmed in booking documents.

  • If delayed (e.g., train or traffic issues), you must contact the event organiser as soon as possible.
  • If you do not communicate, transport will wait a maximum of 30 minutes beyond the scheduled departure time, after which the challenge will proceed without you, and no refunds will be issued.

12. CANCELLATIONS BY SUMMIT CLUB

In the unlikely event that Summit Club cancels your challenge (for operational or severe weather reasons), you will receive a full refund, including your deposit. Summit Club is not liable for personal costs or third-party bookings you may have made (such as train tickets or hotel stays).


13. FORCE MAJEURE

Summit Club will not be liable for cancellations, delays, or disruptions caused by events outside our reasonable control, including acts of God, war, pandemic, or extreme weather.


14. MINIMUM AGE

Participants must be 18 or older, unless otherwise agreed in writing.


15. INSURANCE

You are strongly advised to arrange your own personal travel insurance covering injury, cancellation, and personal belongings. Summit Club does not provide personal insurance.


16. INTELLECTUAL PROPERTY

All trademarks, branding, text, images, product reviews, video, and audio within the Services are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only. No reproduction, resale, or redistribution is permitted without prior written permission.


17. PRIVACY AND DATA

We will collect and store your personal information for booking and operational purposes only. We will not share your data with third parties without your consent, except where required by law.

18. RELATIONSHIP WITH SHOPIFY

Summit Club is powered by Shopify. All sales and bookings are directly with Summit Club. Shopify is not responsible for any aspect of the booking, participation, or products provided.


19. FEEDBACK

If you submit any ideas, suggestions, or content, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use it for any purpose.


20. ERRORS AND OMISSIONS

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without notice.


21. PROHIBITED USES

You may only use the Services for lawful purposes. You agree not to:

  • Violate any law
  • Infringe any intellectual property
  • Harass or harm others
  • Upload malware or viruses
  • Interfere with the security of the Services

We reserve the right to suspend or terminate your account if you breach these Terms.


22. TERMINATION

We may terminate or suspend your access at any time without notice.


23. DISCLAIMER OF WARRANTIES

The Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied.


24. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Summit Club and its partners will not be liable for any indirect, incidental, or consequential damages related to your use of the Services or participation in any challenges.


25. INDEMNIFICATION

You agree to indemnify and hold harmless Summit Club, Shopify, and their affiliates against any claims, damages, or costs arising from your use of the Services or participation in the challenge.


26. GOVERNING LAW

These Terms are governed by English law. You consent to the jurisdiction of English courts for any disputes.


27. CHANGES TO TERMS

We may update these Terms from time to time. It is your responsibility to check back periodically. Your continued use of the Services constitutes acceptance of any updates.
